أكد ماهر الفيلي الأمين العام للجبهة الفيلية بالعراق أن القضاء العراقي النزيه برهن على إستقلاليته التامة عن تأثيرات السلطتين التشريعية والتنفيذية والكتل السياسية وإقراره الحقوق الدستورية للمكون الفيلي الذي لم تنصفه العملية السياسية والتوافق الوطني المزعوم وإلتفاف الأحزاب المتسلطة على الإستحقاقات الفيلية وإستلابها مع مقاعد الكوتا في مجلس النواب ومجالس المحافظات وسرقتها عنوةً وإكراهاً في وضح النهار وبلا رادع أو ضمير أو إستحياء ولا يختلف في جوهره عن جرائم الفساد المالي والإقتصادي والتحايل على الدستور والقانون.
وفى أول تعليق على حكم المحكم الاتحادية ببطلان المواد الخاصة بتمثيل الفيليين والإيزيديين فى البرلمان العراقي، أكد الفيلي فى تصريحات خاصة لـ الشمس نيوز أن المحكمة الإتحادية العليا أثبتت أنها حامية الدستور والجهة الرقابية والإشرافية الأمينة على تطبيق مبادئ العدالة والمساواة.
تحذيرات من سرقة قرار المحكمة الاتحادية
وأشار الأمين العام للجبهة الفيلية بالعراق إلي أن المكون الفيلي لم ينصفه أحد ولا الأحزاب التي قدم في سبيلها الدماء الطاهرة والتضحيات الجليلة بل أنبرى القضاء العراقي العادل لإنصاف هذا المكون المضطهد والدفاع عنه من خلال إصداره قرار المحكمة الجنائية العراقية العليا الخاص بإعتبار ما تعرض له المكون الفيلي جريمة إبادة جماعية وقيام مجلس القضاء الأعلى بتشكيل اللجنة القضائية للإشراف على إعادة الحقوق القانونية للمكون الفيلي.
وحذر الفيلي من سرقة هذا القرار القضائي التاريخي الجسور والإلتفاف عليه وتجييره لمصلحة القوى السياسية الفاسدة التي تتلاعب بمقدرات المكون الفيلي وتحرفها عن مساراتها الدستورية الصحيحة.
حكم تاريخي للمحكمة الاتحادية بالعراق
وكانت المحكمة الاتحادية بالعراق قد قضت اليوم الثلاثاء بعدم دستورية الفقرات الخاصة بمقاعد الإيزيديين والشبك والكورد الفيليين في مجلس النواب.
وعلى خلفية الدعوى المقامة من خالدة خليل رشو، عضو مجلس النواب العراقي، على المدعى عليه رئيس مجلس النواب اضافة لوظيفته، أصدرت المحكمة قرارها.
ونص قرار المحكمة على أن الفقرة (ب) من البند الثاني من المادة 13 نصت على ان المكون الازيدي لديه مقعد واحد في محافظة نينوى فان ذلك يتعارض واحكام المواد 14 و16 و20 من الدستور، اذ يجب معامل المكون المذكور كسائر باقي مكونات الشعب العراقي مما يقتضي الحكم بعدم دستوريتها.
واضافت ان ذلك يقتضي التصدي لاحكام الفقرة (د) من البند ثانيا من المادة 13 من ذات القانون، والتي نصت على ان المكون الشبكي لديه مقعد واحد في محافظة نينوى والتصدي لاحكام الففقرة (هـ) من البند ثانيا من المادة 13 من ذات القانون، والتي نصت على مكون الكورد الفيليين لان لديهم مقعدا واحدا في محافظة واسط ووجوب معاملة المكونات الايزيدية والصابئة المندائية والمكون الشبكي والكورد الفيليين بمعاملة كافة ابناء الشعب العراقي.
وقررت المحكمة الاتحادية العليا الحكم بعدم دستورية الفقرات (ب) و(د) و(هـ) من البند ثانيا من المادة 13 من قانون الانتخابات رقم 9 لسنة 2020 والغائها واعتبارا من تاريخ صدور هذا القرار والعدول عن قرارها السابق بالعدد 45/اتحادية/2020 الخاص بمقعد المكون الكورد الفيليين.
