نائب رئيس برلمان كردستان: جلسة اليوم صحيحة وتأجيلها باطل
أصدر نائب رئيس برلمان كردستان هيمن هورامي، بيانا توضيحياً حول المناوشات التي شهدتها جلسة اليوم الاثنين.
وقال هورامي وهو قيادي في الحزب الديمقراطي في بيان، إن رئيسة البرلمان (ريواز فائق وهي قيادية في الاتحاد الوطني) حاولت بطريقة غير مشروعة وغير منتظمة إنهاء الجلسة ومغادرتها، وعلى ضوء الصلاحيات الممنوحة لنائب رئيس البرلمان، في المادة 19 من النظام الداخلي “ممارسة جميع صلاحيات الرئيس في غيابه” ترأس الجلسة.
وأضاف أنه “منذ بدء الجلسة تم ضمان النصاب القانوني وكان جدول الأعمال قانونياً وإجرائياً بالكامل، فلا تملك رئيسة البرلمان صلاحية تأجيل الجلسة، استناداً إلى الفقرة الثالثة من المادة (18) من النظام الداخلي، بدلاً من ذلك، إذا كان التأجيل ضروريًا، وفقًا للفقرة الثانية من المادة 48، فسيكون ذلك من سلطة الرئاسة بموافقة الأغلبية البرلمانية، وبما أن أغلبية أعضاء الرئاسة وأغلبية أعضاء مجلس النواب كانت لصالح استمرار الجلسة، فإننا نعلن:
أولاً، يجب أن يكون لجميع نتائج الاجتماع قيمتها القانونية وقواعدها.
ثانياً: بسبب خروج رئيسة البرلمان من القاعة ومبنى البرلمان تعتبر غائبة، وبناءً على ذلك، ووفقًا للفقرة (1) من المادة (19) من النظام الداخلي، يمارس نائب رئيس البرلمان جميع صلاحياته ولا تتطلب أي تفويض. لذلك فإن كل رسالة موقعة من نائب رئيس البرلمان بخصوص نتائج الجلسة رقم (4) بتاريخ 22-5-2023 ترسل إلى أي مؤسسة لها كل القيمة القانونية.
وعلى صعيد مواز، قال هورامي في مؤتمر صحفي عقده عقب جلسة البرلمان، إن “مسألة مفوضية الانتخابات هي قضية حساسة بسبب عدم وجود الكثير من الوقت على إجراء الانتخابات، ويوم امس حاولنا كثيرا مع رئيسة البرلمان لأدراج موضوع المفوضية في جدول أعمال الجلسة لنتمكن من اتباع الخطوات القانونية”.
وفي وقت سابق اليوم الاثنين، استأنف برلمان اقليم كردستان، جلسته بعد أن رفعها بسبب “عراك بالايدي بين نواب”، وصوت على تفعيل مفوضية الانتخابات.
وبحسب وكالة شفق نيوز، إن برلمان إقليم كردستان صوت على تفعيل المفوضية المستقلة للانتخابات، موضحا أن البرلمان صادق على القرار بعد تصويت 58 نائبا عليه.
وألقت الخلافات السياسية ولاسيما بين الديمقراطي الكوردستاني والاتحاد الوطني على حسم اجراء الانتخابات، على الرغم من تحديد رئيس إقليم كوردستان نيجيرفان بارزاني يوم 18-11-2023 موعداً لإجراء الانتخابات النيابية بدورتها السادسة في الإقليم.
