في مأزق جديد للجمهوري الذي يحلم بالعودة إلى الرئاسة الأميركية في 2024، يواجه الرئيس الأميركي السابق دونالد ترمب تهماً وجهها له القضاء الفيدرالي، ما يطرح تساؤلات عن إمكانية ترشحه.
وللإجابة على ذلك، وأوضح ريتشارد هاسن، أستاذ القانون بجامعة كاليفورنيا في لوس أنجلوس، في وقت سابق من هذا العام أن “لا شيء يمنع ترامب من الترشح في حال إدانته”، بحسب شبكة “سي إن إن”.
ويتطلب الدستور ثلاثة أشياء فقط من المرشحين، وهي أن يكون مواطناً بالفطرة ويبلغ من العمر 35 سنة على الأقل، ومقيماً في الولايات المتحدة لمدة 14 عاماً على الأقل.
أما من الناحية السياسية، ربما يكون من الأصعب على المرشح المتهم، والذي يمكن أن يصبح مجرماً مداناً، أن يفوز بالأصوات. ولا تسمح المحاكمات للمرشحين بتقديم أفضل ما لديهم. لكن لا يحرم عليهم الترشح أو الانتخاب.
بدورها، قالت جيسيكا ليفينسون، المدير المؤسس لمعهد الخدمة العامة بكلية Loyola Law School، لصحيفة USA TODAY سابقاً: إنه “من الناحية القانونية، لا يوجد ما يمنع رئيساً سابقاً وجهت له اتهامات بارتكاب جريمة حكومية، والترشح للمنصب حتى في حال إدانته”.
وتابعت “لقد أصبح الأمر حقاً مجرد مسألة عملية، إذ كيف يمكنك إدارة البلاد خلف القضبان، إذا حدث شيء من هذا القبيل؟”.
لا قيود دستورياً
ولا توجد قيود في دستور الولايات المتحدة تمنع أي شخص متهم أو مدان بارتكاب جريمة، أو حتى يقضي عقوبة بالسجن حالياً، من الترشح للرئاسة أو الفوز بها.
وحتى لو تمت محاكمة ترامب وإدانته في إحدى ما يسمى بـ “المحاكمات السريعة” فلا يزال بإمكانه إدارة حملته الرئاسية بأكملها من زنزانة السجن، بحسب تقرير لصحيفة “إندبندنت”.
ومثلما لا توجد قيود في الدستور على الشخص الذي يرشح نفسه أثناء توجيه الاتهام إليه، لا يوجد تفسير لما يجب أن يحدث في حالة فوزه.
ولا يوجد أي شيء في الوثيقة من شأنه أن يمنح ترمب تلقائياً تأجيلاً من السجن، باستثناء احتمال أن تكون أي تهم توجهها السلطات الفيدرالية، إذا كانت لا تزال قيد التقاضي عند النقطة التي تولى فيها الرئاسة للمرة الثانية، بسبب رفض وزارة العدل مقاضاة رئيس حالي.

يذكر أن ترامب أعلن، الخميس، أن القضاء الفيدرالي وجه إليه تهما لإدارته لوثائق البيت الأبيض في مأزق جديد للجمهوري الذي يحلم بالعودة إلى الرئاسة الأميركية في 2024.
وكتب على شبكته الخاصة للتواصل الاجتماعي “تروث سوشيال” أن “إدارة (الرئيس جو) بايدن الفاسدة أبلغت محاميّ بأنني متهم رسميا، على الأرجح في قضية الصناديق الوهمية”، في إشارة إلى صناديق الوثائق التي نقلها إلى منزله عندما غادر واشنطن.
وأوضح الملياردير الذي داهم عملاء مكتب التحقيقات الفيدرالي (أف بي آي) منزله في فلوريدا الصيف الماضي، بحثا عن الأرشيف أنه استدعي للمثول الثلاثاء أمام محكمة فيدرالية في ميامي.
