استبعاد القذافي من رئاسة ليبيا

في تطور مفاجئ، قررت مفوضية الانتخابات بليبيا استبعاد سيف الإسلام معمر القذافي من قوائم مرشحي الانتخابات الرئاسية المقررة في 24 ديسمبر المقبل.
وجاء استبعاد القذافي ضمن 25 اسما استبعدتهم المفوضية العليا للانتخابات الليبية من قائمة المرشحين للرئاسة، بينما أبقت على القائد العسكري، خليفة حفتر، ورئيس الحكومة، عبد الحميد الدبيبة.
ويأت القرار بعد طلب وكيل النيابة بمكتب المدعي العام العسكري في ليبيا المفوضية العليا للانتخابات، بإيقاف أي إجراءات تخص ترشح كل من سيف الإسلام القذافي، وحفتر، في انتخابات الرئاسة الليبية، وذلك لاتهامهما بارتكاب جرائم حرب.

وأثار القرار جدلا قانونيا خاصة مع الإبقاء على ترشح عبد الحميد الدبيبة والذى مازال يشغل منصب رئيس الحكومة الحالية، الأمر الذي يعتبر مخالفا لنص المادة 12 من قانون رقم 1 لسنة 2021 بشأن انتخاب الرئيس.
كانت المفوضية العليا للانتخابات الليبية قد نشرت عبر حسابها في تويتر، القائمة الأولية لمرشحي الانتخابات الرئاسية وتضمنت عدد 73 مترشحا للانتخابات المقررة في ٢٤ ديسمبر المقبل.
وأوضحت المفوضية في بيانها أن فترة الطعون المبينة في المادة 48 من القانون تشير إلى أن الطعن في إجراءات وقرارات المفوضية يكون خلال المدة القانونية المحددة.

وكان سيف الإسلام القذافي، قد تقدم بأوراق ترشحه مرتديا ملابس تشبه ملابس أبيه في مركز المفوضية، في الأيام الأولى من فتح باب التقدم بطلبات المشاركة في الانتخابات.
وطالبت المحكمة الجنائية الدولية بـ لاهاي السلطات الليبية بتسليمها القذافي المتهم ارتكاب “جرائم ضد الإنسانية”.
وفى وقت سابق من العام 2015، قضت محكمة في طرابلس بإعدام سيف الإسلام غيابيا في اتهامات بارتكاب جرائم حرب تتضمن قتل محتجين خلال الانتفاضة. وقالت المحكمة الجنائية الدولية في حينه إن المحاكمة لم تف بالمعايير الدولية.
وقال سيف الإسلام في مقابلة يوليو الماضي، إنه يريد “إحياء الوحدة المفقودة” في ليبيا بعد عقد من الفوضى، ولمح وقتها إلى احتمال الترشح للرئاسة.
وظل مصير سيف الإسلام غامضا لأربع سنوات خلت، إذ اختفى بعد أن أعلنت المجموعة التي تحتجزه الإفراج عنه في يونيو 2017.

وكانت مجموعة مسلحة في مدينة الزنتان (جنوب غربي طرابلس) قبضت على القذافي في نوفمبر 2011، بعد أسابيع من مقتل والده، ومن ثم حكم عليه بالإعدام.
لكن المجموعة المسلحة رفضت تسليمه إلى سلطات طرابلس أو المحكمة الجنائية الدولية التي تتهمه بارتكاب جرائم ضد الإنسانية، خلال الثورة التي أسقطت نظام حكم والده في فبراير 2011.
