اعتقال نتنياهو وقادة الاحتلال..هل يمكن أن تفعلها الجنائية الدولية ؟

كثر الحديث خلال الأيام القليلة الماضية عن احتمالية صدور قرار من المحكمة الجنائية الدولية باعتقال رئيس الوزراء الإسرائيلي بنيامين نتنياهو وكبار قادة دولة الاحتلال بسبب الحرب على غزة.
وتحدثت تقارير صحفية أن المحكمة الجنائية الدولية تستعد لإصدار أوامر اعتقال بحق مسؤولين إسرائيليين كبار، بينهم نتنياهو، بتهم تتعلق بالحرب المتواصلة على قطاع غزة لليوم الـ206 على التوالي وأسفرت عن مقتل أكثر من 34 ألف شخص.
ونقلت صحيفة معاريف الإسرائيلية عن مصادر لم تسمها، أن نتنياهو “خائف ومتوتر بشكل غير عادي” من احتمال صدور مذكرة دولية باعتقاله.

ما التهم التي ستوجه للإسرائيليين؟
وفي حال كانت المحكمة تعمل على هذا الأمر، فمن المحتمل أن يتم اتهام المسؤولين الإسرائيليين بمنع إيصال المساعدات الإنسانية إلى قطاع غزة واتباع رد شديد القسوة على الهجمات التي قادتها حماس في 7 أكتوبر/تشرين الأول الماضي، وفقا لمسؤولين إسرائيليين تحدثوا لصحيفة “نيويورك تايمز”.
وقال المسؤولون الإسرائيليون، الذين يشعرون بالقلق من التداعيات المحتملة لمثل هذه القضية، إنهم يعتقدون أن نتنياهو من بين الأشخاص الذين قد يتم ذكر أسمائهم في مذكرة الاعتقال.
يُشار إلى أن المحكمة الجنائية الدولية تقوم بالتحقيق في تصرفات إسرائيل في الضفة الغربية وقطاع غزة، بشكل مستقل عن القضايا الأخرى في محكمة العدل الدولية، مثل الدعوى التي قدمتها جنوب أفريقيا حول “الإبادة الجماعية في غزة”.
لكن هل تستطيع المحكمة الجنائية اعتقال نتنياهو؟
“الجنائية الدولية”، ومقرها في لاهاي، هي المحكمة الدولية الدائمة الوحيدة في العالم التي تتمتع بسلطة محاكمة الأفراد المتهمين بارتكاب جرائم حرب وإبادة جماعية وجرائم ضد الإنسانية.
وليس لدى المحكمة قوة شرطة خاصة بها. وبدلا من ذلك، تعتمد على أعضائها البالغ عددهم 124، والتي تشمل معظم الدول الأوروبية ولكن ليس إسرائيل أو الولايات المتحدة، لاعتقال الأشخاص الذين وردت أسماؤهم في مذكرات الاعتقال.
كما لا يمكنها محاكمة المتهمين غيابيا.
وأي أوامر اعتقال ستتطلب موافقة لجنة من القضاة ولن تؤدي بالضرورة إلى محاكمة أو حتى اعتقال فوري للأهداف.

تأثير المذكرة
لم يكشف المسؤولون الإسرائيليون عن طبيعة المعلومات التي دفعتهم إلى القلق بشأن احتمال صدور مذكرة عن المحكمة الجنائية الدولية التي لم تعلق هي الأخرى على الأمر.
غير أنه من المحتمل أن يُنظر إلى أوامر الاعتقال الصادرة عن المحكمة في معظم أنحاء العالم على أنها توبيخ أخلاقي مهين، خاصة لإسرائيل، التي واجهت منذ أشهر ردود فعل دولية عنيفة بسبب سلوكها في غزة، بما في ذلك من الرئيس الأمريكي جو بايدن، الذي وصفها بأنها “تجاوزت الحدود”.
ويمكن أن يؤثر ذلك أيضا على سياسات إسرائيل في الوقت الذي تضغط فيه البلاد بشأن حربها في غزة.
كما يمكن لأوامر الاعتقال الصادرة عن المحكمة أن تشكل عقبات أمام سفر المسؤولين المذكورين فيها.
وقال أحد المسؤولين الإسرائيليين للصحيفة الأمريكية، إن إمكانية إصدار المحكمة مذكرات اعتقال قد تم إيصالها إلى صناع القرار في تل أبيب، خلال الأسابيع الأخيرة، لكنهم لا يعرفون المرحلة التي وصلت إليها العملية.
وسبق أن أكد كريم خان، المدعي العام للمحكمة، أن فريقه يحقق في حوادث وقعت خلال الحرب.

نتنياهو يعلق
وفي تعليق له، قال نتنياهو “تحت قيادتي، لن تقبل إسرائيل أبدا أي محاولة من جانب المحكمة الجنائية الدولية لتقويض حقها الأصيل في الدفاع عن النفس. إن هذا التهديد بالاعتقال أمر مثير للغضب”.
هل يمكن لأمريكا أن تتدخل؟
وفق وسائل إعلام إسرائيلية، فإن الولايات المتحدة هي جزء من جهد دبلوماسي أخير لمنع المحكمة الجنائية الدولية من إصدار أوامر اعتقال ضد نتنياهو ومسؤولين إسرائيليين آخرين.
في موقع “والا” الإخباري، كتب المحلل بن كاسبيت أن نتنياهو “تحت ضغط غير عادي” بشأن احتمال صدور مذكرة اعتقال ضده وضد إسرائيليين آخرين، الأمر الذي سيكون بمثابة تدهور كبير في مكانة إسرائيل الدولية.
وحسب المحلل، يقود نتنياهو “حملة متواصلة عبر الهاتف” لمنع صدور مذكرة اعتقال، مع التركيز بشكل خاص على إدارة الرئيس الأمريكي جو بايدن.
والولايات المتحدة، مثل إسرائيل، ليست من بين 124 دولة وقعت على نظام روما الأساسي للمحكمة الجنائية الدولية.
